Despite not being an eyewitness to the murder of Mr. Nesbitt, José Delgado, his employee, has been called to the witness stand by the prosecution in the trial of Steve Harmon. José is described as articulate, which certainly makes his testimony all the more credible.

He starts by telling the court that he normally goes out to grab a bite to eat in the afternoon as he works at the store until late, nine o'clock, to be precise. On this particular occasion, he left the store between 4:35 and five o'clock. At that point everything was fine. When José returned, he went round the back of the counter where he saw Mr. Nesbitt's body lying in a pool of blood. He noticed that the cash register had been opened and that a lot of cigarettes were missing, maybe five cartons. Straight away, José called the police, even though he already knew that Mr. Nesbitt was dead.

In response to a question from the prosecution, José confirms that he's a martial arts champ with a black belt in karate. Whenever he competed in a match and it made the local papers Mr. Nesbitt would always put the article in his store window. The robbers undoubtedly saw one of these articles, which probably accounts for why they targeted the store when José was on his lunch break.
