Tom has known that Jim was free: "He ain't no slave; he's as free as any creature that walks this earth!"  Miss Watson, in her will, had freed Jim two months before.  Tom keeps this information from Huck and Jim, and later offers Jim money for his troubles.  Because Tom knew all along that Jim was free, he felt like he could join Huck and Jim in their adventure without fear of punishment.
