In MI, if a minor disaffirms a contract, how is the consideration to be returned, in present condition or in the condition it was originally recieved?
I'm not sure I understand your question because minors can not enter into contracts per say. Minors can purchase a car etc. which is a contract, but most need a co-signer if the car is financed. Nevertheless, the rule is that the item be returned in the original condition as much as possible. Sometimes this of course is not possible and the Court's recognize that. If however it can be returned in the original condition then that prevails.
The age of majority is 18 but there are a few situations were someone less than 18 can be emancipated. For example, a 16 year old female has a child, she is now considered an adult in most states.
