The ACLU believes that capital punishment violates the Constitution’s ban on cruel and unusual punishment as well as the requirements of due process and equal protection under the law. It publishes and distributes numerous books and pamphlets, including The Case Against the Death Penalty and Frequently Asked Questions Concerning the Writ of Habeas Corpus and the Death Penalty.
