It is possible to tell whether something has been settled out of court, when it does not come to court. It can be settle between the two parties through verbal or written communication or by two lawyers. The more serious the case, the more likely lawyers will come together and bargain. In some ways this is much more preferable than going through the whole law process, which can by time consuming, emotionally draining and expensive. And when it works well, there can be a good compromise. I have had personal experience in this area and it worked out well.
