Students with disabilities, such as emotional disabilities, health impairments and traumatic brain injury are covered under Section 504 of the Rehabilitation Act and the Americans with Disabilities Act.
These acts state that any school that receives federal funding must provide appropriate education to students regardless of their disability. This includes kindergarten through twelfth grade schools, as well as higher education. School districts are required to provide free education to anyone with a disability residing within their area.
In order to be considered to have a disability under Section 504, a student must have a documented disability, be perceived to have a disability, or have a disability that limits activities of daily living.
