In civil procedure under Subject matter jurisdiction.  When a plaintiff does not meet the 75,000 jurisdictional amount.  Can they ask for consequential damages under a good faith in federal court without being dismissed?

Are you refering to the Diversity of Citizenship provided for in the U.S. Judiciary Code?

Damages have to be plead for at that amount if you wish a lawsuit to go forward when the parties are from different states.

If you are refering to NON Diversity actions, the 75 grand is not applicable.
