In "Great Expectations", what will happen to Magwitch if he is caught in England?

Why does Herbert tell Pip to get Provis (Magwitch) out of England?

    Magwitch was released from prison when he promised to go to Austrialia and never return to England. He has been a success in Austrailia but longs to see Pip, who he has made into a gentleman. In returning to England, he is breaking his promise not to return and risks execution. So Herbert tell Pip that Provis (or Magwitch) must be taken out of England before he is caught on English soil. Nevertheless, Magwitch is captured and sentenced to death, but he is already dying of injuries he sustained in his capture.
